What Is an FFL?
A Federal Firearms Licensee (FFL) is a person or business holding a license issued by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) under the Gun Control Act of 1968. FFLs are authorized to buy, sell, import, manufacture, or transfer firearms under federal law. Every retail gun store, every online gun retailer, and every dealer who facilitates interstate transfers must hold an FFL.
When You Need an FFL
Under 18 U.S.C. § 922(a)(3), you must use an FFL whenever you receive a firearm from someone who is not a resident of your state — this applies to online gun purchases, mail-order receipts, transfers from out-of-state family members, and any transfer crossing state lines. The seller ships the firearm to the FFL in your state, the FFL receives it into their bound book, runs the NICS background check on you, and transfers the firearm after you complete ATF Form 4473.
Many states also require an FFL for intrastate private sales — California, Colorado, Connecticut, Hawaii, Illinois, Maryland, Massachusetts, Michigan, Nevada, New Jersey, New Mexico, New York, Oregon, Rhode Island, Virginia, Washington, and DC all have universal background check laws.
